EB-5 Project Delivers First Shipment Of Alcohol For The Production Of Hand Sanitizer

The Aemetis EB-5 project company announced its 65 million gallon per year ethanol plant near Modesto, California has begun shipments of 200 proof alcohol for use in the production of hand sanitizer.

Aemetis is now the largest producer of alcohol for sanitizer in the Western US (Midwest ethanol plants produce industrial grade ethanol, but Aemetis is the only large ethanol producer for the sanitizer market located West of Colorado).

“Aemetis is moving quickly to help address the significant demand for hand sanitizer products in light of the COVID-19 pandemic during this time of national emergency,” said Andy Foster, President of Aemetis Advanced Fuels Keyes, Inc. “As the WHO and CDC strongly recommend the use of hand sanitizer products to help prevent the spread of Coronavirus, Aemetis is utilizing our ethanol production capability to address the current shortage of hand sanitizer by increasing the supply of high-proof alcohol used in the manufacturing of sanitizer products,” said Foster.

On March 19, 2020, the Tax and Trade Bureau (TTB) waived provisions of internal revenue law with regard to distilled spirits and provided certain exemptions and authorizations to alcohol fuel producers to produce ethanol-based hand sanitizers to address the demand for such products during the Covid 19 virus emergency. This blanket approval for ethanol producers provided authorization for Aemetis to manufacture sanitizer for such markets as hand sanitizer.

With the recent changes to the H-1B and EB-5 program, our clients will be looking for EB-5 projects that qualify for the lower $900,000 Targeted Employment Area (TEA) investment.

How Does the New TEA Designation Process Change the EB-5 Market?

The change in TEA designation will virtually eliminate more than 75% of the Regional Centers and projects in the market. Regional Center terminations issued by USCIS for inactivity and non-compliance will continue to climb in 2020. New projects with pending application will not qualify nor will existing projects be able to continue to raise EB-5 capital at the discounted level if they don’t meet the requirements. As intended, the focus will shift to projects that are located in more rural areas that are in need of economic stimulus.

The EB-5 Modernization Rule, increased the minimum EB-5 investment amounts for TEA EB-5 projects from $500,000 to $900,000 and the non-TEA minimum investment amount increased from $1 million to $1.8 million. Targeted employment areas are either designated as rural or areas that have an unemployment population that is at least 150% the national average.

Securing TEA designation for an EB-5 project is critical to attract EB-5 investors with its reduced investment amount. EB-5 investors are simply not motivated to risk two times the amount of capital ($1.8 million) to invest in an EB-5 project that does not qualify as a TEA.

Aemetis Advanced Products Keyes, Inc. (“the Project Company”) will construct, operate and maintain a multi-feedstock-capable production facility to produce advanced ethanol, renewable hydrogen, and related products.

The Project Company will also construct, operate and maintain an integrated advanced ethanol facility (“bio-refinery”) using the existing assets at the Aemetis Keyes site and will utilize additional assets at nearby facilities for receiving, preprocessing, and storage of feedstocks.

The new EB-5 project, will use waste wood that accumulates every year out of the California central valley, turning it into fuel grade ethanol that's used in gasoline and sanitizer products.
